These Terms of Service ("Terms") form a binding agreement between you and Hously Technologies Inc. ("Hously"), an Ontario corporation with its head office at 215 Spadina Ave, Suite 400, Toronto, ON. By creating an account, listing a property, or otherwise using the Service you confirm that you have read, understood, and agree to these Terms. If you don’t agree, don’t use the Service.
1. Account use
You must be at least 18 years old and capable of forming a binding contract under the laws of your province or territory. You agree to:
- Provide accurate, complete, and current information when registering.
- Maintain the confidentiality of your password and accept responsibility for all activity under your account.
- Promptly notify us at security@hously.ca of any unauthorized access.
- Use the Service only for personal, non-commercial purposes — except where you are a verified agent or brokerage operating under a paid subscription.
We may suspend or terminate your account for material breach of these Terms or where required by applicable law.
2. Listings and user content
If you post a listing (a "User Listing") you represent that:
- You are the owner, the owner’s authorized representative, or a licensed real-estate professional engaged by the owner.
- The information provided is true, accurate, and complete to the best of your knowledge.
- You have all necessary rights, including copyright, to upload photos, floor plans, and video content.
- The listing complies with the rules of TRESA (Ontario), DICA (BC), OACIQ (Québec) and any other regulator with jurisdiction.
By submitting a User Listing you grant Hously a worldwide, non-exclusive, royalty-free, sublicensable licence to host, display, reproduce, translate and distribute the content solely to operate, promote, and improve the Service. You may delete a User Listing at any time; we will remove it from public view within 24 hours, though copies may persist in backups for up to 35 days.
3. Prohibited conduct
You must not, and you must not allow any third party to:
- Post inaccurate, misleading, discriminatory, or fraudulent listings. Discrimination on prohibited grounds under the Canadian Human Rights Act and provincial human-rights codes is strictly prohibited.
- Reproduce, scrape, harvest, or systematically extract listing data without our prior written consent.
- Attempt to bypass security controls, rate limits, or paywalls.
- Use the Service to send unsolicited commercial communications in violation of CASL.
- Use automated agents, bots, or other automated means to interact with the Service except via documented APIs.
- Impersonate any person, brokerage, or organization.
- Engage in transactions that violate FINTRAC obligations, sanctions law, or the federal Prohibition on the Purchase of Residential Property by Non-Canadians Act.
4. Verification and disputes
We use a combination of automated checks, brokerage cross-reference, and human review to verify agent and listing identity. A verified badge is a representation about our confirmation steps; it is not a warranty about the underlying property. If you believe a listing is inaccurate, you may report it from any listing page. Reports are triaged within two business days. Listings that violate these Terms may be removed without notice. Verified listings carry a clear chain of accountability and are subject to additional review.
5. Subscription and fees
Most features are free for buyers and renters. Agents and brokerages may purchase a paid plan that unlocks additional CRM, analytics, and listing-promotion features. Fees are billed in Canadian dollars plus applicable GST/HST/PST. We may change pricing with at least 30 days’ notice; existing subscriptions continue at the current price until the end of the prepaid term. Refunds are issued on a pro-rated basis for material outages exceeding 24 hours within a calendar month.
6. Limitation of liability
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Hously disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Calculator outputs, market estimates, and AVM ranges are advisory only. Decisions about offers, financing, and real-estate transactions are yours alone, made with professional advice.
To the maximum extent permitted by law, Hously’s total aggregate liability arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) CAD $100. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
7. Indemnification
You agree to defend, indemnify, and hold harmless Hously, its directors, officers, employees, and agents from any third-party claim arising out of (a) your use of the Service in breach of these Terms, (b) any User Listing or other content you submit, or (c) your violation of applicable law.
8. Termination
Either party may terminate this agreement at any time. You may delete your account at any time through account settings. We may suspend or terminate access for material breach, fraudulent conduct, or where required by law. Sections that by their nature survive termination (intellectual property, liability, indemnity, dispute resolution) survive.
9. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
10. Dispute resolution
Before commencing formal proceedings, the parties will attempt in good faith to resolve any dispute by negotiation. If the dispute is not resolved within 60 days of written notice, either party may submit it to mediation administered by the ADR Institute of Canada under its Mediation Rules in Toronto, Ontario. Failing mediation, disputes are subject to the exclusive jurisdiction of the courts of Ontario.
You may also pursue remedies through provincial small claims court where applicable. Nothing in this section limits your statutory consumer rights under the Consumer Protection Act, 2002 (Ontario) or equivalent provincial legislation.
11. Changes to these Terms
We may update these Terms from time to time. For material changes affecting your rights or obligations we will notify you by email and post a notice in your account at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. No waiver of any term is a waiver of any other or subsequent breach.
